  • Except for any warranty provided by the supplier/seller, if any, “My Menu” does not offer any responsibility or guarantee regarding any products provided through the platform, and the user understands the nature of these contracts and their consequences.
  • Through the website and applications, “My Menu” aims to create a distinguished customer journey in e-commerce shopping. Therefore, the terms and conditions related to the stages of this journey are as follows:

Our Terms:

  1. User/Client: The person who orders goods and items from the “My Menu” application/website and must have sufficient legal capacity to perform this process.
  2. “My Menu” or “We”: Refers to the company/specialized trading list and its commercial record: 1009042768.
  3. Homepage: Refers to the main page of the application/website that displays sections, categories, and trademarks facilitated by “My Menu” for user viewing.
  4. Sections: Refers to the main and sub-classifications on our website/application.
  5. Account: Refers to user details, shopping history, and is created upon registration to shop through “My Menu” website or applications.
  6. Commercial Price: Refers to the prices of items that suppliers/owners wish to sell through the platform, displayed on “My Menu” platform and applications, inclusive of any additional charges (taxes, new expenses), excluding transportation costs.
  7. Cash Refund: Refers to the amount accumulated by “My Menu” customers in their electronic wallets in the customer’s account on the website/application. Customers can use the cash refund balance in their electronic wallet to pay for their purchases at any time by choosing to pay with this balance instead of cash or credit card.

Our Conditions: Access:

  1. The website/application may temporarily stop working for periodic or emergency maintenance, or due to force majeure reasons beyond our control.
  2. “My Menu” will periodically repair errors and faults as much as possible.
  3. By using our electronic windows, the customer fully acknowledges that this use falls within their responsibility for contractual actions they undertake, and “My Menu” aims are legitimate.
  4. The customer solely bears the consequences of sharing their username, password, email, or login code sent by “My Menu” with any person, establishment, or entity.
  5. The user is not entitled to use or exploit any software vulnerabilities or bugs to affect “My Menu” service or gain any unauthorized advantage, and agrees to compensate for any such actions.
  6. “My Menu” reserves the right to refuse to deal with the customer if threats, physical or verbal violence are used towards any customer service, delivery, or any person involved with the platform.

Content:

  1. “My Menu” updates its platform content periodically without committing to a specific time, type, or quantity.
  2. The customer must independently note the update date, if any, understanding the possibility of errors or oversights.
  3. We may update the application/website from time to time, and content may change at any time. However, please note that any content on the application/website may become outdated.
  4. Intellectual property rights and all rights on the website/application or any part thereof, whether owned by “My Menu,” the user, or any third party, are as per the categories owned by “My Menu.”
  5. The user acknowledges the legal responsibility incurred by using any data traceable to “My Menu” without written permission, and agrees to compensate for any penalties imposed by “My Menu” for this.
  6. If there is a system or legislation preventing “My Menu” from owning any rights or automatically obtained data from using the website/application, the customer agrees to grant “My Menu” all permissions within the limits permitted by law to collect, use, and share such data.

Modification:

  • From time to time, we will make changes or amendments related to these policies, and within the systems in place, we will inform the user accordingly.

Purchase Conditions: A. Access:

  1. You must be legally qualified to make purchases.
  2. You must have the necessary tools to pay in cash directly or through accepted credit cards and electronic wallets at “My Menu,” and what is imposed for expenses for various cash or electronic payment operations.
  3. The customer must treat login data with utmost confidentiality. Responsibility towards using the account associated with this data by him, or any person, establishment, or entity accessing it through login data is his own responsibility.
  4. If you are initially convinced that your data is no longer sufficiently secure, or if you believe that someone else may know or use your data to access your account at “My Menu,” contact us immediately.
  5. The user agrees to waive their right to access their account at “My Menu” if it suspends it due to suspicions of any fraudulent activity, and in case of misuse of services, or any reason “My Menu” believes is objectively appropriate for cancellation or suspension of the account.
  6. The receipt of your request notification without mentioning the confirmation of the request by “My Menu” does not constitute a legitimate or legal acceptance of its effects, and “My Menu” has the right to cancel the order when it objectively deems it appropriate to do so.
  7. Some items/goods/services may require additional terms independently mentioned.

Regarding Price:

  1. The price of the specified item/product you ordered is the price listed on the website/application at the time the user submits or modifies the purchase request.
  2. The “My Menu” team strives to provide the best possible service, but errors may occur when providing information about products and prices through the “My Menu” application/website.
  3. We cannot confirm the product price until the purchase request is submitted.
  4. In case a product is listed at an incorrect price or with incorrect information due to pricing or product information errors, we reserve the right, at our sole discretion, to contact you for guidance or cancel your purchase order and notify you of this cancellation.
  5. In all cases, “My Menu” has the right to adjust prices and notify you of any changes.
  6. If “My Menu” accepts your purchase order, the same amount will be deducted from your credit card account, and you will be notified by email or text message. You will be liable to pay in cash upon delivery if cash payment is chosen or when we cannot deduct from the card.
  7. “My Menu” may process credit card payment before sending the requested product.
  8. In all cases, if we need to cancel the purchase order after processing payments, the mentioned amount will be refunded to your credit card/debit card account, or a credit balance may be provided to your wallet or account on the website/application.
  9. The user agrees that prices and product availability are subject to change without prior notice. Furthermore, product descriptions/performance are based on catalogs and technical prints printed by suppliers/agents. Thus, the writing available on each product does not belong to us and is subject to change without prior notice.
  10. In addition to the price, delivery or collection fees may also be required.

Acceptance of Purchase Request:

  1. According to our sole discretion, “My Menu” reserves the right to reject or cancel any purchase order for any reason.
  2. Purchase transactions are sometimes or always subject to some restrictions:
  • Restrictions on available purchase quantities.
  • Inaccuracies or errors in product information or pricing.
  • Problems identified by the credit and fraud department at “My Menu.”
  • Or similar matters that we determine as per need and with a single will are some cases that may lead to order cancellation.
  1. Additional information may be requested before accepting any purchase order.
  2. We will contact you if your entire order or any part of it is canceled. Or if additional information is needed to accept your request.
  3. If your order is canceled after deducting the amount from your credit card/debit card, the mentioned amount will be returned to your wallet on the “My Menu” platform. If you wish to transfer the amount to your credit card account, the customer must notify “My Menu” of the amounts requested for transfer, and this notification falls within the limits of his responsibility, without the slightest bearing from “My Menu.”
  4. It is the user’s responsibility to ensure the effectiveness of the credit/debit card when processing the refund.

Regarding Non-Receipt of Order:

  1. If there is no authorized person to receive the order at the user’s specified location, the driver will wait a maximum of 10 minutes before leaving the designated location.
  2. The driver will communicate with the user by calling the registered mobile number only.

Regarding Order Modification:

  1. “My Menu” reserves the right not to accept modification and cancellation requests. If such requests are accepted, you must follow up on your request with the technical support team.
  2. Considering how “My Menu” systems work, if you wish to add products to your submitted order, you can reorder by contacting customer service.
  3. Orders canceled after delivery or partially canceled during delivery are subject to cancellation fees determined by “My Menu,” not exceeding the order value, with deduction from the refunded amount for delivery and processing.
  4. The user agrees and waives their right not to object to the decision made by “My Menu” regarding receipt of orders and accepts it as it is.
